On the issue of whether MINUSTAH has any legal burden for infecting Haiti with Cholera, I was provided link to the contract between UN and Haiti which would seem to absolve the UN troops of any responsibility. However, recently in the wake of the Airport incident, it would seem that the UN military is not operating under that agreement, so there's a precedent established.
Here's my rewrite on thread (b):
Q. Will this evidence stand up in a court of law?
A. In my opinion, there is no court of jurisdiction.
Plus, the agreement between Haiti and UN absolves the UN of any responsibilities.
However, sometimes UN military have said the peacekeepers are bound by Haitian law.
There was an incident where Brazilian troops stormed the airport in an armed assault to get their luggage through customs. In the subsequent investigation, those troops were identified, sent home to Brazil in disgrace. The commander of MINUSTAH reminded all of that military that they are the guests of Haitian people, and they are subject to the laws of the country and must comply with these laws, and the people in charge of law enforcement.
So, are there any laws on Haitian books regarding it being a no no to introduce a serious disease into the country?
